The algorithm for processing documents for foreign citizens to open individual entrepreneurship (IP) in Russia includes several stages:
Stage 1. Obtaining permits
Foreigners wishing to register an individual entrepreneur in Russia are required to first legalize their stay in the country by obtaining a temporary or permanent residence permit (residence permit):
- Temporary residence permit (residence permit) or temporary residence permit (temporary residence permit) are mandatory for foreigners planning to engage in entrepreneurial activity in Russia.
- The exception is citizens of the EAEU countries (Belarus, Kazakhstan, Armenia, Kyrgyzstan), who are allowed to register as individual entrepreneurs without a residence permit or RVP.
Stage 2. Document Package Collection
Before submitting an application, you must collect a package of documents:
- Completed application for state registration of an individual as an individual entrepreneur (form No. P21001).
- Copy of the passport of a foreign citizen with translation into Russian, certified by a notary.
- Temporary residence permit or residence permit in Russia (for third-country nationals).
- INN (if any).
- Document confirming payment of state duty (800 rubles).
- Power of attorney if registration is performed by a representative (notarized).
When submitting documents through the MFC, an additional document will be required - consent to the processing of personal data.
Stage 3. Tax regime selection
Before submitting documents, it is advisable to choose a tax regime. Most often, foreign entrepreneurs choose a simplified taxation system (STS), since it is easier to administer and saves on taxes.
Stage 4. Filing
Documents are submitted to the territorial division of the Federal Tax Service (FTS) in one of the following ways:
- personal visit to the department of the Federal Tax Service;
- mail with declared value and list of attachments;
- supply via multifunction center;
- electronic submission through the State Services portal or the website of the Federal Tax Service of Russia (you must first confirm your electronic signature).
The term for consideration of the application is five working days from the date of submission of documents.
Stage 5. Obtaining a certificate of registration
After five working days, the applicant receives a record sheet of the Unified State Register of Individual Entrepreneurs (USRIP), indicating the fact of registration.
Possible limitations
There are some restrictions for foreign citizens when opening an individual entrepreneur in Russia:
- It is forbidden to conduct activities in some areas of the economy (defense industry, state security, etc.).
- Citizens of a number of countries are required to follow additional migration procedures and regularly renew their residence permit.
- There is no automatic access to many government small business support programs provided exclusively to Russian citizens.
